What gambling is legal under Illinois law?

Illinois broadly prohibits games of chance or skill played for money or value and wagers on contests, then creates product-specific exceptions. Legal routes include licensed casinos and video gaming terminals, IGB-authorized sports wagering, the Illinois Lottery, pari-mutuel racing, qualifying charitable games and regulated multi-participant fantasy contests. Illinois does not license real-money online casino or online-poker sites. Availability, a “skill” or “sweepstakes” label, or an offshore license is not Illinois authorization; match the activity, operator, channel and location to the controlling law.

A label does not decide Illinois legality

Apply the legal test to the product’s actual mechanics and authorization chain. These five common claims fail for different reasons.

Article 28 expressly covers a game of chance or skill played for money or value. Skill matters only when a specific exception or authorized framework makes it matter.

A Sports Wagering Act authorization covers the approved sportsbook route. It does not create an Illinois real-money online-casino or poker license.

A lawful VGT route depends on the terminal, terminal operator, eligible establishment and local status. A licensed VGT establishment is not an Illinois casino.

The free-entry exception is fact-specific. Check whether payment or purchase is actually required, what value can be won, how redemption works and whether another express Illinois authorization exists.

It does not prove Illinois authorization. Match the exact product to the Illinois exception, regulator and current record.

2026 fantasy transition

The Illinois framework took effect June 16, 2026. An operator already offering contests before that date may continue until 90 days after implementing rules take effect; the statute then provides a temporary-permit path for a timely application and fee. The statute does not convert that rule-dependent transition into a fixed calendar deadline. Verify any named operator against a current IGB permit or license record; do not call it licensed without one.

Qualifying multi-participant fantasy contests conducted under the Act do not constitute gambling. Single-participant contests against the operator are excluded from the statutory definition; exclusion from that definition is not separate authorization.

Disputed event-contract boundary

The IGB has issued cease-and-desist letters asserting that specified sports-event contract products are unlicensed sports wagering. Those letters state the agency’s position; they are not a final court ruling on every prediction market. A federal market designation is not an IGB sportsbook authorization.

What can follow an Illinois gambling-law violation?

“Illegal gambling penalty” is not one result. The conduct, subsection, prior conviction, property and civil claim determine the route. This table reports statutory categories, not a prediction about charging, guilt or recovery in a specific case.
