West Virginia Sports Betting:What Is Legal and Live in 2026

Check the bettor, session, official route, event, wager and record before treating an available betting screen or retail ticket as proof.

CURRENT ANSWER

Is sports betting legal and live in West Virginia?

Sports betting is legal and live in West Virginia through West Virginia Lottery–licensed operators and approved retail and mobile channels. Bettors must be 21 or older. Under the ordinary mobile route, a wager must be placed while the bettor is physically inside West Virginia through a verified personal account. Professional, collegiate, motor-racing and esports events can qualify; other events need Commission authorization. Events must satisfy the rule; markets follow operator house rules. A license-list row, app access or accepted deposit alone does not prove authorization.

This source-led guide is general information, not legal, tax or betting advice and not a firsthand sportsbook test.

Use all eight checks

West Virginia sports-bet permission and record check

One green signal cannot replace another. Complete Stage A for the bettor and session, then Stage B for the event and wager. If an official link in the chain is unknown, pause rather than infer.

Stage A — Bettor and session

  1. Check

    Confirm the Article 22D route.

Find the operator/MSP/legal entity and approved host or platform relationship in current Lottery records.

    Evidence-safe pass
The current official chain is complete for the route being used.
    Stop when
A logo, app-store page, registrant row, another state's license or unsupported brand match is the only proof.
    Official locator
    §§29-22D-2, -5 and -6; current Lottery license/action records
  2. Check

    Confirm the bettor is eligible.

The bettor is at least 21 and is not self-excluded, acting as a proxy, barred by employment or prohibited by participation in the event.

    Evidence-safe pass
Age and prohibited-person checks pass for this bettor and event.
    Stop when
Age, identity, exclusion or participant status is unknown or fails.
    Official locator
    §29-22D-15; Rule §§2.22 and 23–26; §29-22D-25 for racing participants
  3. Check

Confirm the channel and physical location.

Retail uses an approved location; under the ordinary mobile route the wager originates while the bettor is physically inside West Virginia.

    Evidence-safe pass
The approved channel and in-state placement signal both pass.
    Stop when
The bettor is across the border, geolocation fails or the location/platform is not approved.
    Official locator
    §§29-22D-6 and -15; Rule §§3.8 and 15
  4. Check

    Confirm the personal verified account.

Mobile wagering uses the bettor's verified, nontransferable account; no account sharing or proxy.

    Evidence-safe pass
Identity and account ownership are verified for the person placing the wager.
    Stop when
The account belongs to someone else, verification is incomplete or a proxy is involved.
    Official locator
    Rule §§14.1–14.3

Stage B — Event and wager

  1. Check

Classify the event and wager type.

Match the event to a named category or a specifically Commission-authorized other event; confirm required first-time category/type notice and that no Director prohibition applies.

    Evidence-safe pass
The named-category or specifically authorized other-event lane, required notice and prohibition status are resolved.
    Stop when
The category, wager type, required notice, other-event authorization or prohibition status is unresolved.
    Official locator
    §29-22D-3; Rule §7.1
  2. Check

    Verify the exact event conditions.

The outcome can be verified; the outcome can be generated by a reliable and independent process; the outcome will not be affected by any wager; and the event is conducted in conformity with all applicable laws.

    Evidence-safe pass
The event meets every Rule §7.2 condition.
    Stop when
The outcome-verification, reliable-and-independent-process, wager-effect or applicable-law condition fails or is unknown.
    Official locator
    Rule §7.2
  3. Check

Verify the exact market and house rule.

Confirm the available wager is displayed with its event number, odds and a brief event description; then read the approved and posted/available house rule for settlement, schedule changes, odds/proposition notice, cancellation, redemption and ticket expiry.

    Evidence-safe pass
The exact wager is displayed with the required event number, odds and description, and the governing house rule is available before placement.
    Stop when
The wager display omits the required event number, odds or description; the market is not offered; or the applicable approved and available rule or settlement term cannot be identified.
    Official locator
    Rule §§5.5–5.6 and 7.4
  4. Check

Use a permitted funding path and save the record.

For a retail wager in a sports-wagering lounge or other approved casino area, confirm the method fits Rule §7.3 and the applicable approved and posted house-rule funding term. For online sports-wagering account funding, confirm the method fits Rule §14.4 and that same operator-specific house-rule check; save ticket/account identifiers, time, location, amount, potential payout and terms.

    Evidence-safe pass
The applicable retail-wager or online-account method is permitted under the corresponding rule and approved controls, and the complete record is preserved.
    Stop when
The retail/online lane, permitted category or operator-specific posted funding term is unknown; a permitted category is mistaken for availability or a recommendation; or the ticket/account/house-rule record is missing.
    Official locator
    Rule §§5.5–5.6, 6.18, 7.3 and 14.4–14.11

All eight confirmed

Evidence supports treating this as the regulated Article 22D route. That is not a recommendation, legal opinion or guarantee of settlement or payout.

One check is unknown

Pause before funding or wagering. Use the official locator and preserve the screen or document showing what remains unresolved.

One check fails

Do not treat the product, session or wager as West Virginia-authorized. Do not bypass location, identity, account or exclusion controls.

What these records do not establish

A license row is not a live app

An MSP, supplier, registrant, DBA, contract or approval row proves only its stated record. Current consumer availability needs separate evidence on the authorized sportsbooks page.

A defined event is not an offered market

Professional, collegiate, motor-racing or esports language opens a possible category; other events need specific authorization. Required notice, no Director prohibition, Rule §7.2 event conditions, the Rule §7.4 displayed wager and the operator house rule still must be resolved.

Access or a deposit is not authorization

An app screen, account, geolocation pass or accepted funding method cannot replace the Article 22D chain.

An accepted ticket is not a guaranteed outcome

Acceptance does not promise that the wager will settle as expected, survive a schedule change, remain unvoided or produce a payout.

A permitted funding category is not a recommendation

Rule §7.3 lists permitted categories for retail wagers in a sports-wagering lounge or other approved casino area, while Rule §14.4 separately lists permitted online-account funding categories. The applicable approved and posted house-rule funding term under Rules §§5.5–5.6 establishes operator-specific availability. A permitted category alone neither proves that availability nor makes a method advisable.

This guide is not individualized advice
