CURRENT ANSWER

Is gambling legal in West Virginia?

West Virginia permits several regulated forms of gambling, but each follows a different license and age rule. Casino gaming, limited video lottery, online casino and poker play, and sports wagering are generally 21+, while Lottery and pari-mutuel or advance-deposit racing routes begin at 18. Five casino properties anchor the regulated market, with separate Lottery, Racing Commission and Tax Division channels. Website access or an MSP license row alone does not prove a live West Virginia consumer product or personal eligibility.

This is a current statewide status and verification guide, not personal legal, tax or financial advice. Location, identity, account, exclusion, property-access and operator rules can still make a person or transaction ineligible.

How West Virginia gambling authorization fits together

Premium West Virginia licensed-facility evidence composition

1 · Licensed facility

The four racetrack casinos and the single historic-resort facility anchor casino, sports and iGaming relationships. The property/facility layer does not by itself name every live consumer product.

Premium West Virginia MSP-license ledger composition

2 · MSP license row

The July 15, 2026 official PDFs show 12 iGaming and 10 sports MSP rows. A row proves an approved license relationship and dates—not a live app, current brand or product count.

Premium West Virginia live-product verification chain

3 · Consumer brand and live product

A visitor-facing brand needs current product-level evidence tied to the licensed chain. An ad, old SERP snippet, supplier record or maximum skin allowance is not enough.

Premium West Virginia personal-eligibility verification composition

4 · Personal eligibility

Age, physical location, identity, account, self-exclusion, property access and product terms still control the individual transaction after the product is authorized.

Why Limited Video Lottery is its own market

LVL is a distributed adult-premises system with its own law, operator/retailer layers and terminal controls. Do not merge it with racetrack video lottery or online casino gaming.

9,000 is a cap

The statute allows no more than 9,000 LVL terminals statewide. It does not report how many are installed or active today.

Approved adult premises

Play belongs inside the licensed restricted-access area of an approved retailer; under-21 and visibly intoxicated play is barred.

Seven is the default retailer limit

A retailer is ordinarily limited to seven terminals. Up to ten requires Commission authorization under the statutory exception; do not describe ten as universal.

Payment-area restrictions matter

The retailer duties include restrictions on ATM, credit and debit access in the playing area. Do not transfer this wording to casino floors or iGaming accounts.

Four checks before you use a West Virginia gambling route

Authorization is only the first check. Apply the product-specific eligibility, current-record and action-route rules before relying on a site, venue or account.

Check the age for the product

Casino gaming, LVL, sports wagering and interactive wagering are 21+. Retail Lottery, iPLAY and pari-mutuel/ADW wagering begin at 18. A racetrack property can contain both an 18+ racing lane and a 21+ casino floor, so venue admission is not the answer.

Separate physical location from residency

Sports wagering and iGaming generally require the wager to originate while the person is physically in West Virginia; they do not impose a general West Virginia-residency rule. iPLAY purchases also use in-state location. ADW is the exception here: its account holder must be 18+ and a West Virginia resident.

Keep the current tax record

TSD 432, revised June 2026, shows 4.58% West Virginia withholding when the applicable federal withholding trigger is met. Withholding is not final tax liability, all gambling winnings may be reportable, and records matter. Keep records and use qualified tax help for personal facts.

Use the right complaint or exclusion route

For a sports or iGaming complaint, contact the regulated provider first. That operator must investigate and respond within 10 calendar days. If the matter remains unresolved after reasonable efforts, use the WV Lottery complaint/Director route. Racing complaints go to the Racing Commission. The iPLAY exclusion request does not cover sports, iGaming, LVL or casino activity. For gambling harm, call or text 1-800-MY-RESET or use NCPG chat now.

Six limits before relying on a gambling claim

Each statement below prevents a common West Virginia category error. Treat it as a stop condition, not a disclaimer to ignore.

An MSP row is not a live app

A dated iGaming or sports MSP row proves a licensed relationship and dates. It does not prove a public brand, current launch, product inventory or app count.

Physical presence is not residency

Sports/iGaming/iPLAY location controls and the ADW West Virginia-residency rule are different tests. Do not transfer one product's requirement to another.

Statutory authorization is not current availability

Fixed-odds racing is authorized, but a current live consumer offer was not proved. Require current operator-level evidence before saying it is available.

A sweepstakes label or site access is not a license

West Virginia does not publish a sweepstakes-casino license category. Exact mechanics, terms, current law and official action control; this guide gives no blanket legal or illegal verdict.

Withholding is not final liability

The current 4.58% state withholding figure applies only when the relevant trigger is met. It is not a personal tax-rate estimate, and the older 4.82% Lottery page is not the source winner.

One form does not cover every problem

iPLAY exclusion is not casino/sports/iGaming/LVL exclusion, and the sports/iGaming complaint form is not the racing, retail Lottery, LVL or casino dispute route. Gambling-harm support is separate from regulation.

West Virginia gambling FAQ

Is gambling legal in West Virginia?

Yes, through separate regulated or state-run systems. West Virginia has casino gaming, Limited Video Lottery, sports wagering, interactive wagering including online casino games and poker, traditional Lottery/iPLAY, pari-mutuel racing/ADW and qualifying charitable gaming. The exact license, channel, age and eligibility rule still control.

What is the legal gambling age in West Virginia?

It depends on the product. Casino gaming, Limited Video Lottery, sports wagering and interactive wagering are 21+. Retail Lottery, iPLAY and pari-mutuel or advance-deposit racing wagering begin at 18. A racetrack property can contain both an 18+ racing lane and a separate 21+ casino floor.

Are online casinos and online poker legal in West Virginia?

West Virginia authorizes regulated interactive wagering for people 21+ who meet account and physical-location controls. BetRivers Poker launched in West Virginia on June 10, 2025, and a first-party May 3–17, 2026 series documents later activity. This snapshot does not certify present-day availability. An MSP license row or website alone does not prove that a particular consumer product is live; verify the complete licensed chain and current product record.

Do I have to live in West Virginia to gamble online?

Not for the general sports-wagering or interactive-wagering location rule: the wager must originate while the person is physically in West Virginia or another specifically approved jurisdiction. iPLAY purchases also use in-state location. Advance-deposit racing wagering is different because the statutory account-holder definition additionally requires West Virginia residency.

How many casinos are in West Virginia?

The regulated property framework has five casino properties: four racetrack casinos and The Greenbrier historic-resort gaming facility. Greenbrier has statutory access restrictions and is not an unrestricted public walk-in casino. Limited Video Lottery locations are a separate distributed-terminal system and are not additional casinos.

What is Limited Video Lottery in West Virginia?

Limited Video Lottery is a separate WV Lottery regime for terminals in approved restricted-access adult premises. The statewide statutory cap is 9,000, which is not the current installed count. A retailer is generally limited to seven terminals, with up to ten only through the statutory Commission-authorized exception.

Are sweepstakes casinos legal in West Virginia?

This guide does not give a blanket legal or illegal answer for every sweepstakes or social-casino model. West Virginia does not publish a Lottery casino-license category for those sites, and access, a foreign license or a sweepstakes label does not establish state authorization. Exact purchase, free-entry and prize mechanics, terms, current law and official enforcement records control.

Who regulates gambling in West Virginia?

The West Virginia Lottery controls traditional Lottery, casino gaming, Limited Video Lottery, sports wagering and interactive wagering through distinct programs. The West Virginia Racing Commission controls horse/dog racing and pari-mutuel/ADW routes. The West Virginia Tax Division handles charitable-gaming licensing/guidance and state tax administration.

Are West Virginia gambling winnings taxable?

Gambling winnings can have federal and West Virginia reporting consequences even without a W-2G. TSD 432, revised June 2026, shows 4.58% West Virginia withholding when the applicable federal withholding trigger is met. Withholding is not final liability. Keep records and use qualified tax help for personal facts.

Where do I file a West Virginia gambling complaint?

Use the route for the product. For a sports or iGaming complaint, contact the regulated provider first. That operator must investigate and respond within 10 calendar days. If the matter remains unresolved after reasonable efforts, use the WV Lottery complaint/Director route. Racing complaints go to the Racing Commission. Retail Lottery, LVL and casino issues have different routes, so the sports/iGaming form is not universal.

Does West Virginia iPLAY self-exclusion cover casinos, sportsbooks and iGaming?

No. The WV Lottery iPLAY self-exclusion page expressly says that its request does not exclude a person from sports betting, iGaming, Limited Video Lottery or casino activity. Use the separate route for each product. For immediate gambling-harm support, call or text 1-800-MY-RESET or use NCPG chat.
