How to File a Gambling Complaint in West Virginia
Identify the channel, act before the applicable clock, preserve the record and use the official route that actually covers the problem.
Current answer
How do I route a West Virginia gambling complaint?
Start with the channel that took the wager. For a West Virginia-regulated sportsbook or iGaming account, contact the operator first, preserve the case number and records, then use the West Virginia Lottery’s Sports & iGaming Complaint Form if the issue remains unresolved. Retail casino, Lottery, limited video lottery, racing, charitable-gaming and unrecognized-operator problems use different routes and deadlines. A complaint creates a record; it does not guarantee a refund, ruling or response date.
First decision · channel and owner
Where should your West Virginia gambling complaint go?
Use the row for the product and selling channel involved. A shared property brand does not merge its casino, sportsbook, iGaming, Lottery or racing complaint rules.
| Issue or channel | Do this first | Official destination | Published clock | Save now | Boundary |
|---|---|---|---|---|---|
| Regulated sports wagering | Contact the exact operator’s customer support. Save the case number, response and posted house rules. | Sports & iGaming Complaint Form (opens in a new tab) only if unresolved after operator contact. | Operator investigates and responds within 10 calendar days under active 179CSR9 §3.7. | Account/wager ID, settlement screen, transaction history, house rule, support record. | Not a state result deadline; form dropdown is not provider proof. |
| Regulated iGaming | Contact the exact operator’s support and use its published complaint method. Save the case number and response. | Sports & iGaming Complaint Form (opens in a new tab) only after reasonable operator means are exhausted. | Operator investigates and responds within 10 calendar days under active 179CSR10 §5.5. | Account/game/session/transaction IDs, result screen, terms, history and messages. | Not for a retail casino, Lottery/iPLAY, LVL, racing, charity or unrecognized site. |
| Racetrack casino table game or gaming device | Report it to the casino and immediately ask the casino licensee for its supplied Commission complaint form. | Give the completed written complaint to the on-site WV Lottery employee for Commission forwarding. | Patron filing: within 5 calendar days of the incident. Do not wait for the casino’s separate 10-business-day investigation period. | Name/contact, exact date/time/table/device/location, staff/witnesses, resolution attempt, video relevance. | Four racetrack casinos only; sports/iGaming web form does not replace the supplied form. |
| Greenbrier limited gaming facility | Report it to the facility and immediately ask the facility licensee for its supplied Commission complaint form. | Give the completed written complaint to the on-site WV Lottery employee for Commission forwarding. | Patron filing: within 5 calendar days. Facility investigation: 10 business days; written answer after licensee receipt of the complaint copy: 14 business days. | Name/contact, date/time/table/device/location, staff/witnesses, facility response, requested review. | Greenbrier rule only; do not use the racetrack-casino or sports/iGaming form by analogy. |
| Traditional Lottery, iPLAY, ticket or retailer | Preserve the original ticket/claim record. Use the exact retail-prize or iPLAY account route for that product. | Retail prize claims (opens in a new tab) for retail;for iPLAY, use iPLAY payments, winnings and withdrawals (opens in a new tab), Player Support 833-376-0384 or customersupport@wvlottery.com. | No universal complaint clock proved. Claim/presentation rules are product-specific; act promptly and keep the original. | Original ticket or iPLAY account record, draw/game, date, amount, claim/support response. | Claim forms are not general complaint forms; sports/iGaming form is not this route. |
| Limited Video Lottery terminal or retailer | Stop using the terminal, preserve the printed ticket and report the exact location/terminal to the licensed retailer immediately. | WV Lottery Contact Us (opens in a new tab);ask for Limited Video Lottery Security. Call 800-982-2274. | A printed ticket must be presented within 10 days; no weekend/holiday extension applies. Narrow exception: if, in the Commission's opinion, an act of God such as flooding makes the gaming system at that retail location inoperative, the period is interrupted until operation is restored. No separate universal patron-complaint clock was proved. | Original ticket, print time, terminal/location, amount, display/error, retailer response. | Retailer-first and asking Customer Service for LVL Security are practical guidance, not a published appeal prerequisite or refund promise. |
| Racing, pari-mutuel ticket or ADW | Track/window: make the complaint to the association before leaving; for a pari-mutuel-clerk transaction, put it in signed writing before race-day end and request the report/reference. ADW: use provider terms/support first and save every account record. | West Virginia Racing Commission Contact Us (opens in a new tab);call 304-558-2150 after the applicable first route. | Association reports covered complaints immediately and sends them within 48 hours. No universal ADW patron deadline/response clock was proved. | Original ticket or ADW confirmation, association/provider, race, amount, time, support/report reference. | Same-race-day clerk rule is not a universal ADW rule; operator-first for ADW is an operational inference. |
| Charitable bingo or raffle | Preserve the ticket, drawing/platform record and organizer response; contact the organizer/licensee first if safe. | West Virginia Tax Division Bingo and Raffle (opens in a new tab);call 304-558-3333 for license/compliance routing. | No dedicated universal public patron-dispute form, response clock or individual-remedy clock was proved. | Organizer/licensee, event, ticket/payment, advertised terms, drawing/result and correspondence. | Organizer-first is practical guidance; Tax Division is not WV Lottery and no remedy is promised. |
| Unrecognized operator, deceptive offer or cybercrime | Do not send more money or contact an alleged scammer if unsafe. Preserve URLs, messages, payment records and account identifiers. | WV Attorney General consumer complaint (opens in a new tab) for deceptive commercial conduct; WV State Police crime tip (opens in a new tab) for suspected crime; FBI IC3 (opens in a new tab) for cyber-enabled fraud. | No universal recovery/response clock. Immediate danger or crime in progress: call 911. | Exact URL/entity, ad/offer, messages, payment method/recipient, transaction IDs, platform report and loss chronology. | Do not use the regulated form, contact the alleged scammer first or promise investigation/recovery. |
Five-day stop: A physical casino patron who wants Commission review asks for the supplied complaint form immediately. The casino’s ten-business-day investigation period does not extend the patron’s five-calendar-day filing clock.
Second decision · do not transfer a clock
Read the clock before you wait
The clock follows the product and rule, not the shared property or company name.
5 calendar days
Physical casino patron filing
For racetrack-casino or Greenbrier table/device disputes, request the supplied Commission complaint form immediately and submit within five calendar days. Do not wait for the separate casino/facility investigation period.
10 calendar days
Regulated sports/iGaming operator response
Active Rules 179-9 and 179-10 require the operator to investigate and respond within ten calendar days. This is not a Commission decision deadline, refund deadline or consumer filing deadline.
No universal public clock proved
Lottery, LVL, racing/ADW, charity and unrecognized routes
Product ticket/claim clocks can still apply. Act promptly, preserve originals and ask the official owner which exact rule or term controls; this page does not calculate a personal deadline.
Third decision · freeze the reviewable record
Save this before the record changes
Keep originals and export account records before a screen, message, term or transaction history changes.
- Your legal name and safe contact details. Include the account email or phone only when relevant; never include a password or one-time code.
- Exact business or channel. Record the operator legal/consumer name, property, retailer, track, charitable organizer or website URL.
- Product and access route. Sportsbook, iGaming, table/device, Lottery/iPLAY, LVL, pari-mutuel/ADW, bingo/raffle or unrecognized offer.
- Incident date, time and time zone. Add physical location or device/session context when it affects the record.
- Account, customer, case or ticket identity. Use only the minimum identifier needed; redact unrelated digits.
- Wager, game, draw, table, device, terminal, transaction or window ID. Preserve the exact label shown.
- Amount and money path. Record deposit, withdrawal, wager, payout or payment transaction IDs without exposing full bank/card credentials.
- Original screenshots or photographs. Preserve full context and original timestamps; do not crop away URL, date, balance or error context.
- Terms, house rules, promotion or policy in force. Save the URL, visible version/date and relevant text rather than paraphrasing only.
- Account statement, bet/game history or original physical ticket. A photograph is backup, not a substitute when the original matters.
- Support trail. Preserve case numbers, transcripts, emails, agent names, dates, responses and promised next steps.
- Chronology and requested review. State what happened, what record proves it, what the first recipient did and the specific action or explanation requested.
Security stop: Never include passwords, one-time codes, Social Security numbers, seed phrases, full payment-card numbers or full bank credentials. Share sensitive documents only through a verified secure official channel and only when requested.
Fourth decision · write a reviewable chronology
Build a complaint the reviewer can follow
Lead with the exact record, not accusations or a full account history. The official Sports & iGaming description field accepts at most 500 characters; keep the complete evidence packet separately for secure follow-up.
- What happened? Give the specific disputed action, result, error, nonpayment or representation and the exact date/time.
- What record identifies it? Name the account, ticket, wager/game/draw/table/device/transaction ID and amount.
- What did the first recipient do? Give the contact date, case number and response—or state that no response was received.
- What specific review do you request? Ask for one record, action, correction or explanation; do not demand an unsupported guaranteed remedy.

Fifth decision · understand the next state
What happens after you file
The next step depends on the recipient. Preserve the submission confirmation and do not infer a result from acknowledgement alone.
| Recipient / process | What the checked source supports | What to preserve | What it does not promise |
|---|---|---|---|
| Regulated sports/iGaming operator | The operator investigates and responds within 10 calendar days. The applicable unresolved record can move to the Lottery/Director route. | Submission, case number, response, account/wager/game record and the terms relied on. | A favorable answer, payment, account reopening, Commission decision or deadline extension. |
| WV Lottery / Commission physical-casino record | The licensee investigates; after the licensee receives the complaint copy, it answers the Commission and patron within 14 business days. The Commission decides whether investigation is needed. | Supplied form, delivery proof, casino response, witness details and referenced surveillance/event record. | That every filing is investigated, that discipline occurs or that money is returned. |
| WV Attorney General Consumer Protection | The Division reviews the submission and may contact the business through voluntary mediation; complaint patterns can inform enforcement work. | Confirmation, chronology, contract/receipt, correspondence, desired resolution and current contacts. | Gaming jurisdiction, adjudication, attorney representation, compulsory participation, refund or enforcement in an individual case. |
| FBI IC3 / law-enforcement information | IC3 can analyze and refer cyber-enabled fraud information; police routes receive suspected-crime reports. | Confirmation, exact URLs/entities, messages, payment/transaction records and any safe platform report. | A status update, response, investigation, recovery, anonymity or emergency response. |

Six stops · route and remedy boundaries
Use the complaint route—not the wrong shortcut
1 · West Virginia is not Virginia or the UK
Use the owner with West Virginia authority. A Virginia regulator, UK Gambling Commission page or generic national form does not gain jurisdiction because a search result says “WV” or “gambling commission.”
2 · The online form is not universal
The WV Lottery page is literally the Sports & iGaming Complaint Form. Its dropdown is not a license list and the form does not replace casino-supplied, Lottery, LVL, racing, charitable or unrecognized-operator routes.
3 · Do not transfer a clock
Five calendar days belongs to the specified physical-casino patron filing; ten calendar days belongs to regulated sports/iGaming operator response. Other product clocks remain product-specific.
4 · A complaint is not legal or payment advice
Filing does not decide a chargeback, arbitration, lawsuit, claim, tax or criminal option and does not pause another deadline. Obtain qualified advice for an individual legal or financial choice.
5 · A dispute is not a harm or emergency route
Self-exclusion and gambling-support services protect the person; they do not adjudicate a wager. Call or text 988 for suicide or emotional crisis and call 911 for immediate danger or emergency response.
6 · A record is not a promised outcome
Submission, acknowledgement, mediation or referral does not guarantee a reply, investigation, discipline, refund, reversal or recovery. Preserve confirmation and disclose sensitive records only through a verified secure channel.
